FCA Chrysler loses bid to kick out Dodge Dart Class Action

FCA Chrysler recently lost a major court hearing where they attempted to “de-certify’ the pending class action regarding the allegedly defective transmissions in the following vehicle models:

  • 2013-2015 Dodge Dart vehicles equipped with a Fiat C635 manual transmission

Here, Dodge Dart owners claimed that the “vehicle's clutch to fail and stick to the floor,” as well as preventing gears from engaging and disengaging, amongst other driveability problems. These issues were originally written about here.

The great news here is that the court rejected every single one of FCA’s arguments, basically stating that the potential class members are easily identifiable, FCA lacks affirmative defenses to the class action, and damages are easily ascertainable, thus “ based on the reasoning above, the Court DENIES Defendant's motion to certify class action.” The entire opinion can be read here.
