GMC Acadia Shift To Park Class Action Certified (but only in one state)

A GMC Acadia "Shift to Park" putative class action has finally been certified as a class action, but only for consumers in Tennessee (which may not be a bad thing)

According to the class action lawsuit, shift to park messages show on 2017–2018 GMC Acadia SUVs even though the cars are already in park mode due to design flaws.

According to reports, even when the Shift to Park notification appears, the GMC Acadia won't stop.

Plaintiff Rilla Jefferson claims that after shifting into PARK and attempting to turn off the SUV, her Acadia would not switch off. She then noticed the phrase, "Shift to Park." From there, she had to jiggle the gear shifter from PARK to NEUTRAL or DRIVE and then put the shifter back into the PARK position, which besides being annoying, can also be dangerous if you can’t properly shift your car.

The plaintiff then filed a motion to certify the Tennessee class action lawsuit on November 2, 2022.

Presiding Judge McCalla dismissed certain claims against GM, including claims regarding loss-of-use damages and injunctive relief. However, the judge refused to dismiss breach of contract and breach of express warranty claims. He also ruled the case can proceed under a "diminution of value theory of damages."

The motion for class action certification is granted as to initial purchasers and lessees of new 2017-2018 GMC Acadia SUVs who purchased or leased their vehicles in Tennessee.
