NISSAN CVT LAWSUIT SETTLEMENT FOR ROGUE AND PATHFINDER

Similar to the other Nissan CVT Class Actions that I’ve written about extensively, a new class action proposed settlement has been reached concerning the Nissan Rogue, Nissan Pathfinder, and Infiniti QX60.

Per documents filed with the presiding court in Stringer v. Nissan North America, Inc., a class wide settlement has been reached between Nissan and vehicle owners who allege the continuously variable transmissions (CVT) are defective.

The Nissan class action settlement includes the following vehicles:

  1. 2014-2018 Nissan Rogue

  2. 2015-2018 Nissan Pathfinder

  3. 2015-2018 Infiniti QX60

Essentially, if the class wide settlement is approved by the judge, then Nissan will extend the terms of the new vehicle limited warranty for the transmission assembly (including the valve body and torque converter) and transmission control unit. The warranty will be extended by 24 months or 24,000 miles, whichever occurs first, and the warranty extension will be subject to the same terms as the original warranty. This is very similar to the other settlements approved for the Nissan Sentra, Nissan Altima and Nissan Versa.

This is still very new since the proposed settlement documents were filed on 10/7/2021. The judge will still have to approve the settlement and, generally, there is a longer process involved with when the extended warranties will be issued to vehicle owners, along with deadlines for opting out of the class action.

More significantly, if you’re in California and you own a 2014-2018 Nissan Rogue, 2015-2018 Nissan Pathfinder, or 2015-2018 Infiniti QX60 with CVT problems and do not want to join the class action and be bound to the terms of it, then you should contact us immediately with the form below. Under California Lemon Law, if a vehicle is deemed to be a lemon, you’re potentially entitled to what you paid for the vehicle (as opposed to receiving an extended warranty.). As such, it is likely that pursuing an individual lemon law action could prove to be a better option, rather than joining the class action.
